All intellectual property rights in and to the OCWins Platform — including but not limited to software, design, text, graphics, logos, data compilations, and interfaces — are owned by or licensed to OCWins. Nothing in these Terms transfers any intellectual property rights to the Member.
Members are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for personal, non-commercial gaming and entertainment purposes. Any other use — including reproduction, redistribution, framing, or scraping of Platform content — is strictly prohibited without the prior written consent of OCWins.
To the maximum extent permitted by applicable law, OCWins, its officers, employees, agents, and licensors shall not be liable to any Member for:
OCWins' total aggregate liability to a Member in respect of any claim arising out of or in connection with these Terms shall not exceed the total amount deposited by that Member in the 30-day period immediately preceding the event giving rise to the claim.
Nothing in these Terms shall exclude or limit liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or any liability that cannot be excluded by applicable law.
OCWins reserves the right to suspend, restrict, or permanently close a Member's Account at any time, with or without prior notice, including in circumstances where:
A Member may close their Account voluntarily at any time by contacting Customer Support. Upon Account closure, OCWins will process the withdrawal of any verified Balance remaining, subject to completed KYC and the absence of any pending investigations. Bonus Funds are forfeited upon voluntary Account closure.
OCWins reserves the right to amend, update, or replace these Terms at any time. Material changes will be communicated to Members via in-platform notification or registered email address. The updated Terms will take effect from the date of publication on the Platform.
Your continued use of OCWins following the publication of revised Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must cease using the Platform and request Account closure.
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws applicable to the jurisdiction in which OCWins is incorporated and licensed to operate.
In the event of a dispute, Members are encouraged to contact OCWins Customer Support in the first instance. OCWins aims to resolve all complaints within a reasonable timeframe and in good faith. If a dispute cannot be resolved informally, the parties agree to submit the exclusive jurisdiction of the competent courts in OCWins' home jurisdiction.
Nothing in this clause shall prevent either party from seeking interim or emergency relief from a court of competent jurisdiction to prevent irreparable harm.
